Overview of license verification privacy;
1. CUSTOMER (COMPANY OR EMPLOYER OR DRIVER) REQUIREMENTS:
The Customer represents and warrants to VerX Direct (VXD) that each transaction for License Verification from VXD by the Customer is performed only upon the presentation of a driver’s license and written and/or electronic consent of each driver is freely given to the company.
2. INFORMATION REQUIRED TO COMPLETE THE INQUIRY:
I. Driver license number, to verify that it is currently valid.
II. Date of Birth, to ensure that the license information supplied is correctly entered and matches the license provided.
III. Province of where the license was issued.
IV. Optional - Licence Class
No other information is required to complete the inquiry.
The request will not be registered against the license or driver in any way.
3. INFORMATION RETURNED FROM A JURISDICTION INQUIRY:
Based on the information provided in section 2, the license provided is:
I. Valid – Yes or No.
II. Interlock requirement (Impaired Condition) – Yes or No.
III. Optional – Confirmation of the class provided.
4. CONFIDENTIALITY:
VXD and the Customer agree that all programs or consumer information exchanged between the parties including any driver license information (for the purposes of this section referred to as the “Confidential Information”) shall be kept confidential and shall not be disclosed or made available to any third party. Confidential Information does not include information which is in the public domain at the date of its disclosure to VXD or the Customer or thereafter enters the public domain through no fault of VXD or the Customer; which VXD or the Customer received in good faith from a third-party and which is not subject to an obligation of confidentiality owed to or by the third-party; or which is required by law to be revealed.
5. CONSENT RETENTION:
The Customer shall retain signed consent for a period of up to (3) three year(s) from the date of consent. VXD does not or is required to store or obtain any these consent records unless requested by the Jurisdiction.
6. AUDIT REQUIREMENTS:
VXD, a VXD data provider or a Jurisdiction may require access to the written consent for audit purposes. The Customer will be responsible for providing the driver consent to VXD upon audit request.
7. PURGING OF DATA AND RESULTS:
As part of normal transaction tracking procedures, customer reporting features and audit procedures, all records of the driver license verification transactions will be automatically purged from the VXD systems after 3 (three) years from the date of the transaction.
